These General Terms and Conditions of Sale (GTC) govern the sales of jewelry and accessories made on the website www.bmyany.com, operated by BMYANY.

Article 2 - Purpose
These General Terms and Conditions of Sale are intended to define the rights and obligations of the parties within the framework of the online sale of jewelry and accessories offered by BMYANY.
Article 3 - Products
The products offered are those listed on the website www.bmyany.com. Each product is accompanied by a description prepared by BMYANY. The photographs are as accurate as possible but are not contractually binding on the seller. The sale of the products presented is reserved for buyers residing in the countries to which we deliver.
Article 4 - Price
The prices of our products are indicated in euros (EUR), inclusive of all taxes (VAT). BMYANY reserves the right to modify its prices at any time, it being understood, however, that the price listed in the catalogue on the day of the order will be the only price applicable to the buyer.
Prices do not include delivery charges, which are billed separately and indicated before order confirmation.
Article 5 - Order
The customer places an order on the website www.bmyany.com. For the order to be validated, the customer must accept these Terms and Conditions by ticking the box provided for this purpose.
The sale will only be considered final after BMYANY sends the customer confirmation of acceptance of the order by email and after receipt of the full price.
Article 6 - Payment
Payment can be made by credit card, PayPal, Apple Pay, Google Pay or any other payment method offered on the site.
Payment is due immediately upon ordering. Payment data is exchanged in encrypted form using the SSL protocol.
Article 7 - Delivery
Delivery times:
- Metropolitan France: 3-7 business days
- European Union: 7-14 business days
- International: 10-21 business days
Delivery costs:
- Free delivery in France and the EU for all orders
- Variable fees for international deliveries (calculated at checkout)
Delivery times are given as an indication only. In the event of a delivery delay, the customer will be notified by email.
Article 8 - Right of withdrawal
In accordance with Article L221-18 of the Consumer Code, the customer has a period of 14 days from receipt of the products to exercise their right of withdrawal without having to justify reasons or pay any penalty.
BMYANY offers an extended 30-day return period for all eligible items.
Returns must be made in their original condition and complete (packaging, accessories, instructions). Return shipping is free for mainland France.
Article 9 - Guarantees
Legal guarantee of conformity: The customer benefits from the legal guarantee of conformity provided for in Articles L217-4 et seq. of the Consumer Code.
Warranty against hidden defects: The customer also benefits from the legal warranty against hidden defects provided for in Articles 1641 et seq. of the Civil Code.
Commercial guarantee: All our 925 sterling silver jewelry is guaranteed authentic. Defective products will be replaced or refunded.
Article 10 - Liability
BMYANY cannot be held responsible for non-performance of the contract in the event of stock shortage, product unavailability, force majeure, disruption or total or partial strike of postal services and means of transport.
Article 11 - Intellectual Property
All elements of the website www.bmyany.com are and remain the exclusive intellectual property of BMYANY. Any reproduction, exploitation, redistribution or use of the texts, images, photographs and other elements of the website is prohibited.
Article 12 - Protection of personal data
The personal data collected is necessary for processing the order and issuing invoices. It may be shared with partners responsible for the execution, processing, management, and payment of orders.
In accordance with the GDPR, the customer has the right to access, rectify and delete their personal data by contacting contact@bmyany.com.
Article 13 - Mediation
In accordance with Article L612-1 of the Consumer Code, the customer has the right to use a consumer mediator free of charge for the amicable resolution of the dispute.
Article 14 - Applicable Law and Jurisdiction
These Terms and Conditions are governed by French law. In the event of a dispute, the French courts shall have exclusive jurisdiction.
